Welcome to Engram. These Terms and Conditions ("Terms") govern your use of the Engram website and services operated by Webinci Tech Pvt Ltd ("we", "us", or "our").

By accessing or using Engram, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

1. Accounts & Eligibility

• Eligibility: You must be at least 18 years old to use this service. By using Engram, you represent and warrant that you meet this requirement.
• Responsibility: You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
• Termination: We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe these Terms have been violated.

2. Acceptable Use

You agree NOT to use Engram for any of the following:

• Generating content that is illegal, harmful, threatening, or promotes hate speech.
• Attempting to reverse engineer, decompile, or extract the source code of our platform or AI models.
• Using automated systems (bots, scrapers) to access the service without our express written permission.
• Bypassing or attempting to bypass any security measures or rate limits.

3. Payments & Subscriptions

• Billing: Paid services are billed in advance on a recurring monthly or annual basis. All payments are processed via Stripe.
• Cancellations: You can cancel your subscription at any time through your dashboard. Your access will remain active until the end of the current billing period.
• Refunds: Refund requests are governed by our Refund Policy.
• Price Changes: We reserve the right to modify our pricing at any time, with reasonable notice provided to existing subscribers.

4. Intellectual Property

• Our Content: The Engram interface, branding, and proprietary algorithms are the exclusive property of Webinci Tech Pvt Ltd.
• User Content: You retain ownership of the input data you provide. By using the service, you grant us a worldwide license to process your content solely for the purpose of providing the service to you.
• AI Output: To the extent permitted by law, you own the output generated by the AI based on your inputs. However, due to the nature of machine learning, similar outputs may be generated for other users.

5. Disclaimer of Warranties

"The service is provided on an 'AS IS' and 'AS AVAILABLE' basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or completeness of the AI-generated content."

6. Limitation of Liability

In no event shall Webinci Tech Pvt Ltd, its directors, or employees be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service. Our total liability for any claim shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically the jurisdiction of courts in Uttarakhand, without regard to its conflict of law provisions.
